Railways to consider jobs to children in lieu of VRS

Job in lieu of VRS

Making the safety-related voluntary retirement scheme (VRS) more lucrative, Railways today said it is considering a move to provide employment to the ward of an employee availing the scheme as well as relaxing the age limit under it.

At present, the scheme is available to only gangmen in group D and drivers in group C attaining the age of 55 to 57 years.

Under the new proposal, the scheme will be extended to all safety category staff like pointsmen, khalasi and others.

The age limit will be reduced to 50 years and a ward of the staff will get employment on availing the scheme.

We are considering the move to provide employment to the ward of a railway employee availing the scheme,” Railway Minister Mamata Banerjee said attending a All India Running staff Conference organized by All India Railwaymen’s Federation today on 13 July, 2010 at New Delhi

All India Running Staff Conference of Loco and Traffic Running Staff to be held at New Delhi on 13-07-2010

ALL INDIA RNG CONF

All Loco and Traffic Running Staff LPs, ALPs and Guards attend en-masse the All India Running Staff Conference scheduled to be held at NDLH on 13-07-2010 organized by All India Railwaymen’s federation (AIRF) under Leadership of National Railway Mazdoor Union(NRMU). For following long pending demands of Running Staff":-

  • Constitute High power committee to review duty hours of Running staff to 6Hrs

  • Grade Pay Demands:

  • Asst. Loco Pilot – PB-1 + GP Rs.2800

  • Goods Pilot – PB-2 + GP Rs.4600
  • Loco Pilot (Pass.) – PB-2 + GP Rs.4800
  • Loco Pilot (M/Exp.) – PB-2 + GP Rs.5400
  • Goods Guard – PB-2 + GP Rs.4200
  • Pass Guard- PB-2 + GP Rs.4600
  • Mail Exp Guard- PB-2 + GP Rs.4800
  • Loco Inspectors – PB-2 + GP Rs.5400
  • Rate of Kilometreage of Running Staff should be revised as per Bhalla Committee formula w.e.f. 1.1.2006
  • Additional Allowance to Running Staff – Provision of Special Allowance to all Running Staff incuding LI/SLIs also
  • Remove anomaly of pay fixation of Loco Supervisors inducted prior to 1.1.2006 with reference to their juniors drafted after 1.1.2006

  • Absence/Detention of the running staff from their headquarters should be restricted to 24 Hrs
  • On absorption in alternate employment of medically de-categorized Running Staff 55% retirement benefit to be awarded
  • As CCA subsumed by Transportation Allowance 30% benefit to be awarded

These rates fall far below the rates what they should get. For determining the rates of Running Allowance, Pass. Driver/Guard is taken as a reference grade. Thus, the formula for deciding the rate of Kilometreage Allowance is as under:-

Hence, it is demanded that the rates of Running Allowance, both for Loco & Traffic Running Staff should be revised from 01.01.2006 as follows and all arrears due be paid from that date.

The above rates have been demanded keeping into view the revised basic pay, revised T.A. rates and relativity as per the recommendations of the Running Allowance Committee, 1981 and Railway Board’s letters No.E(P&A)II-97/RS-2 dated 2.4.1998 and No.E(P&A)II-98/RS-5 dated 6.5.1998 on the subject.

The relativity of the rates of Kilometerage of Mail/Exp. Drivers, Goods Drivers, Shunters, Sr. ALP and Second Fireman, Mail/Exp. Guards, Goods Guards, Sr. Brakesman/Sr. Asstt. Guard and Brakesman/Asst. Guard is maintained as per the prevailing practice on Indian Railways since 1981.

Sub: Grant of Children Education Allowance and Hostel Subsidy

Railway Board vide their letter No. E(W)2008/ED-2/4 dated 10.06.2009 have laid down the eligibility for Children Education Allowance as follows:

“Reimbursement of Children Education Allowance is admissible for eldest two surviving children studying in schools affiliated to Board of Education”.

This is contrary to the letter and spirit of the original order issued vide Para 1(c) of Ministry of Personnel, Public Grievances and Pensions O. M. No.12011/03/2008-Estt. (Allowance) dated 02.09.2008 circulated vide Railway Board’s letter No.E(W)2008/ED-2/4 dated 01.10.2008 which reads as under:-

“Reimbursement as indicated above will be applicable for expenditure on the education of school going children only i.e. for children from classes nursery to twelfth, including classes eleventh and twelfth held by junior colleges or schools affiliated to Universities or Boards of Education”.

It is clear from the above paragraph that only for class eleventh and twelfth colleges or schools need to be affiliated to Universities or Board of Education and not from Nursery Class.

It may further be mentioned that schools imparting education at Nursery level, primary level and even middle class level i.e. up to Class VI(Six) are not affiliated to any Education Board. Apart from the above, in road side railway stations even some Secondary Schools are also not affiliated to any State Education Board and students studying in those schools are appearing Secondary Examination through some other affiliated schools. The policy of the Govt. is to spread literacy and if, the restriction imposed by the Railway Board’s letter under reference, many students studying Nursery, Primary and middle School / classes are being deprived of the benefits of Educational Assistance.

It is urged that the Children Education Allowance and Hostel Subsidy may please be granted to any two children studying in schools and in respect of up to middle standard affiliation to Board of Education or from any other authority may not be insisted upon.

Sub: Eligibility for 1st Class/AC-2 Tier and AC 3 Tier Passes

Consequent upon introduction of VI CPC pay scales, staff of all departments other than the Railways, in Grade Pay Rs.4200 and above, are having eligibility of First Class/AC 2 Tier Passes.

It would be appropriate to mention that the VI CPC vide para 4.2.42 has recommended as under:-

“In any case in the revised scheme of pay scales, all the allowances and facilities will be governed by grade pay.”

Hence, it is urged that the Railwaymen in Grade Pay of Rs.4200 and above be issued First Class/AC 2 Tier Passes and those who are in Grade Pay Rs.2400 and 2800 be issued AC 3 Tier Passes.

Sub: Stationary equivalent pay scale for Running Staff – Allotment of comparable grade Pays

The Railway Board vide their letter No.E(NG)I-98/PM2/8 dated 01.10.99 have allotted comparable grades for running staff as follows:-

M&E Driver, Sr. Shunter, Passenger, Sr. Passenger, Motorman,

Sr. Motorman; M&E Guard, Sr. Passenger Guard

Rs.6500-10500

Goods Driver, Sr. Shunter, Passenger Guard, Sr. Goods Guard

Rs.5500-9000

Shunter, Sr. Asstt. Guard, Sr. DAD/EA/1st Fire man

It is urged that comparable grade pay for Running Staff in the stationary posts be considered and instructions issued.

Sub: Abnormal delay in the matter of setting-up of Medical Board, holding of the Board and acceptance of its report – harassment to the employees

After prolong treatment when patients are not declared fit for duty, they often submit application for setting-up of Medical Board to ascertain whether they are likely to be fit for duty or otherwise.

There has been abnormal delay in the matter of setting-up of Medical Board, holding of Medical Board and acceptance or otherwise of the recommendation of the Medical Board appointed for the purpose, causing harassment to the staff. They exhaust their Earn Leave and had to be remained on LWP for months together causing untold sufferings.

Hence, it is urged that some time frame should be drawn for setting-up of Medical Board, holding of Medical Board and acceptance or otherwise of the report of the Board so that the patients are relieved of their mental and economic hardship.

Sub: Appointment of High Powered Committee to review the working hours of Loco & Traffic Running Staff and other safety categories of staff – Implementation of the agreement

In the wake of strike negotiation, the following agreement was reached for reviewing working hours of Loco & Traffic Running Staff and other safety categories of staff.

“A High Power Committee with an eminent Judge of the High Court would be constituted to review the duty hours of Running Staff and other Safety Categories of Staff and other safety categories of staff.”

Despite repeated representations, the High Powered Committee as agreed to has not yet been appointed, causing serious dissatisfaction amongst the Loco & Traffic Running staff and other safety categories of staff.

Staff Side urges the Railway Board to appoint the High Powered Committee, as agreed to, without any further delay, to review working hours of Loco & Traffic Running Staff and other Safety Categories of Staff.

Highlights of first meeting of National Anomaly Committee

The first meeting of the National Anomaly Committee was held on 12th December, 2009.

Fixation of Pay in Revised Pay Scale:

As per Clause (A) (ii) of Rule 7 (i) of Revised Pay Rules 2008, the Pay fixation for the pre revised basic pay of Rs.5600 in the scale of Rs.5000 – 8000 should be (Rs.6500 X 1.86 = Rs.12090) + Rs.4200 GP = Rs.16290, instead of (Rs.5600 X 1.86 = 10420) + Rs.4200 GP = Rs.14620 (As per Clause (A) (i) of Rule 7(i) of Revised Pay rules 2008)

After some discussion, the official side stated to have a re-look into the matter.

Option

First option exercised within three months may not be treated as final and the employees be permitted to revise the option within six month of the date of exercising the first option.

Option exercised by the officials under F.R. 22(I)(A(1) on promotion has been restricted to only first promotion, which appears to be unreasonable.

The official side has agreed to allow another option.

The official side has agreed to examine whether the above option can be allowed to cover all promotions.

Date of Next Increment

Persons, whose increment falls between 1st February and 1st June, 2006 may be given one increment on 1.1.2006 as a one time measure.

It was pointed out by the staff side that, they have made the suggestion for a one time measure on the specific understanding that Rule 9 of the Revised Pay Rules 2008 has no applicable in the fixation of increment date in future as in those cases, the Fundamental Rules will have the application.

Official side agreed to issue orders to cover those in service between 1.1.2006 and 1.7.2006 as a one time measure.

The official side after some discussion agreed to reconsider the issue in the light of the contention made by the Staff Side.

Benefit on Promotion

Staff side proposed that minimum benefit on promotion should not be less than 10% of the Pay+Grade Pay of the feeder post.

Official side will further discuss the issue outside the forum of Anomaly committee.

5.

Fixation on Promotion

On promotion to the higher grade, pay of an employee should be fixed appropriately and in any case it should not be less than the entry Pay in the revised pay structure for direct recruits appointed on of after 1.1.2006 for the post.

The Official Side agreed to issue enabling orders in the matter.

(Anomaly of senior promotive SE/SSE in the GP Rs.4600 fixed less pay than Junior Direct entrant who joined later will be removed.)

6.

Refixation of pension / family pension.

Since refixation of pension has been allowed both under paras 4.1 and 4.2, they should both he covered in para 9 of the OM. It is requested that para 9 of the said OM may be revised including both paras 4.1 and 4.2 thereof.

Orders have been issued vide O.M.dated 12th and 14th September, 2009

7.

Anomaly in pension for Government Servants who retired/Died in harness between 1.1.2006 and 1.9. 2006

The Govt. servants who have retired on or after 1.1.2006 but before the date of issue of this F.No. 38/37/08-P&P(W)(A) dated 2nd September 2008 have been debarred from the benefits of the same. They will be governed by the rules/ orders which were in force immediately before coming into effect of these orders.

Orders are under issue.

Parity in pension of all pre 1996 retirees with those who retired on or after 1.1.2006

After detailed discussion, the official side agreed to consider the issue once again.
